    Profile

    Me Gagné joined Lavin Gosselin’s team in 2020, after ten years working mainly in the agri-food sector.
    Her practice covers administrative and regulatory law, constitutional law, civil litigation and extraordinary recourses. Over the years, she has developed in-depth expertise in the marketing of agricultural products and more particularly those under supply management.
    Since the beginning of her practice, Me Gagné has acted as a litigator and external legal advisor to a clientele of marketing agencies for agricultural products, producers, entrepreneurs and individuals grappling with various legal issues falling under agricultural and civil law. She also held a position of director of an agricultural products marketing board, where she was in charge of the legal affairs of the organization, overseeing its governance and participating in the management of the regulatory system of production and marketing of agricultural products under its jurisdiction.

    She has in particular:

    • drafted numerous regulations governing the production and marketing of agricultural products or the financing of producer offices;
    • worked on the development of a merger of joint plans, drafted the regulatory adjustments to implement it and made the required representations for its approval;
    • ensured the proper functioning of the internal management of organizations and the holding of meetings, including meetings of producers;
    • advised managers and participated in the negotiation and drafting of federal-provincial agreements governing agricultural product marketing regimes;
    • drafted marketing agreements and made the required representations for their implementation;
    • made representations before administrative bodies and courts of law when the constitutional validity of regulatory and contractual texts were contested, as well as in the context of recourses aimed at the application of administrative monetary penalties;
    • made representations to the Régie des marchés agricoles et alimentaires du Québec in the context of a request for the deregulation of the production and marketing of agricultural products;

    She promotes a thoughtful and creative approach as well as a genuine bond with the clients that allows them to be adequately informed about the legal issues applicable to their situation and to create, with them, the solution best suited to their needs.
